Agreement to Terms
By accessing aureus.cx or using any Aureus service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all Terms, you may not access or use our services.
These Terms constitute a legally binding agreement between you and Aureus Hosting Technologies, Inc.
Eligibility and Access
Invite-Only Model
Access to the Aureus platform is granted solely at our discretion on an invitation basis. Submitting an access application does not guarantee membership. We reserve the right to accept or decline any application without explanation.
Account Responsibility
If you are granted access:
- You are responsible for maintaining the confidentiality of your credentials
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorised use
- You may not share, transfer, or sublicense your access to any third party
Acceptable Use
You agree not to use Aureus services to:
- Violate any applicable law or regulation
- Host, distribute, or transmit malware, spyware, or any malicious code
- Engage in activities that interfere with or disrupt the integrity of the platform
- Conduct attacks against third-party systems or networks
- Send unsolicited communications (spam)
- Circumvent or attempt to circumvent security controls
- Mine cryptocurrency without explicit written authorisation
- Store, transmit, or process child sexual abuse material or any illegal content
Violation of these terms may result in immediate termination of access without notice or refund.
Service Availability
Aureus commits to a 99.999% uptime SLA for customers on applicable plans. Scheduled maintenance windows will be communicated in advance. The SLA does not apply during:
- Force majeure events
- Periods of customer-induced disruption
- Attacks on the customer's application
Intellectual Property
All content, software, trademarks, service marks, and logos on aureus.cx are the property of Aureus Hosting Technologies, Inc. and are protected by applicable intellectual property laws.
You retain all rights to your own code, data, and applications. By deploying on Aureus, you do not grant us any ownership rights over your intellectual property.
Payment and Billing
Where applicable:
- Fees are billed in advance on a monthly or annual basis
- All fees are non-refundable except as required by law
- We reserve the right to modify pricing with 30 days' notice
- Overdue invoices may result in service suspension
Termination
We may suspend or terminate your access at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us.
Upon termination:
- Access to the platform will be revoked
- You will have 30 days to retrieve your data
- After 30 days, your data may be deleted permanently
Limitation of Liability
To the maximum extent permitted by law, Aureus and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use our services.
Our total liability for any claim arising from these Terms shall not exceed the amount you paid to Aureus in the 12 months preceding the claim.
Indemnification
You agree to defend, indemnify, and hold harmless Aureus and its affiliates from any claims, damages, obligations, losses, liabilities, and expenses arising from your use of the services or violation of these Terms.
Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or by posting an updated version on this page. Continued use of the services after changes constitutes acceptance.
